Abstract

This master thesis conducts an in-depth exploration of the tax laws in Denmark, which regulates the taxes regarding properties, with a special focus on the tax laws related to a generational change of a agricultural property, when it is time to sell to the next generation. The thesis will focus on optimization of the tax that must be paid, when a sale of properties that have mixed business and personal uses, including examples from a real-life scenario based on the generational change of Tina and Tommy Jensen’s agriculture, to their son or third part. The study aims to illustrate and analyze how the laws operate in real-world situations, and the goal is to dissect the complex layers of the Danish tax laws regarding property tax, when the properties serve different categories. The central question in the thesis is, ‘’How does tax laws affect the generational transfer of the agricultural property, the economical situation of Tommy and Tina Jensen, and how can they optimize taxation in connection to the sale of their property?’’. Through a comprehensive legal and economical course of action, the master thesis evaluates the tax implications of property sales related to the central question and transfers in general, emphasizing the challenges and opportunities that is possible during the sale and generational shift of agricultural properties owned by individuals as Tina and Tommy Jensen. The findings of the thesis reveal how Danish tax law will have big influence regarding the transfer of agricultural properties. The study methodical examines the tax obligations and strategic opportunities available to Tommy and Tinas Jensen during the sale of their agricultural property to either their son or the third-party. The analysis in the thesis demonstrates how the tax regulations significantly affect the financial decisions related to the sale of the property and the conclusion tells that with careful consideration and planning, based on the understanding of the Danish tax laws, property owners like Tina and Tommy Jensen, can significantly optimize the tax payments related to the sale of their agricultural property, and that wrong decisions can have economic consequences, therefore the conclusion highlights the importance of strategic tax planning in maximizing economic benefits, which leads to minimizing tax liabilities during the generational shift of agricultural properties.
