Abstract

The working paper concerns the EU-China Comprehensive Agreement on Investment (CAI) and its climate provision. It gives a descriptive overview of the CAI and the rules on climate change in the context of international climate change law and law of the World Trade Organization (WTO). The CAI has explicit reference to both international climate change law and WTO law, and they are therefore relevant to include in the interpretation of the CAI’s rules on the protection of the climate. The paper identifies certain problems and opens up for further questions that should be more thoroughly addressed in research.
