Regulating Recognition and Reunification of Marriage in the Structure of Global Wealth Accumulation: Law, Economy and Social Domination

Abstract

This thesis studies the regulation of marriage recognition under Private International Law, Migration Law, and International Human Rights Law. Marriage recognition under Private International Law and Migration Law from the doctrinal perspective serves different purposes and should be governed by different legal logics. However, through recent legal developments particularly in North-Western Europe, both types of recognition became approximated in their functions, grammars, and logics. This presents a rupture in the existing doctrinal and intellectual frameworks of both recognitions. It also reshapes the recognitions’ social impact - the form of social and economic stratification performed on their bases.
