Abstract

This chapter focuses on the rules regarding public contract modifications in England, Wales and Northern Ireland as set by the current Public Contracts Regulations 2015 (PCR 2015), in particular reg.72. It shows how the applicable law is mostly shaped by the PCR 2015 and (some) guidance issued since and not as much by case law due to the traditional limited use of judicial review mechanisms in the UK as a whole. Finally, this paper looks briefly as well to the changes proposed by the UK Government Green Paper on public procurement reform which should lead to a new procurement law coming into force in late 2021.
