Abstract

The purpose of this chapter is to introduce and discuss the regulation of behaviour modification through the design of choice architecture in light of European Union data protection law (GDPR) and marketing law (UCPD). In data protection law 'consent' must reflect the data subject's genuine and informed choice. In marketing law the aim is to ensure that 'commercial practices' do not impair the consumer's ability to make free and informed decisions. The chapter focuses on the General Data Protection Regulation (GDPR), the ePrivacy Directive, the Unfair Commercial Practices Directive (UCPD) and the Digital Services Act (DSA).
