Abstract
The aim of the treatise is two-fold.
1) I will give a critical overall reading of the writings of Carl Schmitt 1919-1978 based on the understanding, that Schmitt’s juridical thinking is a historical thinking. A reading that probes beyond Schmitt’s expressed intentions and finds hidden contradictions in the deep structure of his works.
2) On the fundament of the assumptions of general human forces in history and metaphysical ideals of justice, which can be deduced from the overall reading, I will work out a metaphysical theory of justice. In the process of constructing this theory, I take some of Schmitt’s central philosophical concepts as my starting points: anormality, pessimistic anthropology, the human need of legitimacy, the concept of the political, political theology, Leviathan.
