Abstrakt
The purpose of this thesis is to analyze GDPR compliance in relation to third country data transfers, how the balance between data protection and competitiveness affects decision- making in this regard, how fine sizes affect strategies and behavior, and what the EU- Commission can do in order to secure the optimal balance between data protection and competitiveness. EU law (GDPR) and economic theories, such as game theory, are used in the analysis. The legal analysis will analyze the current legal state of data transfers to third countries. The economic analysis will analyze how the balance between data protection and competitiveness affects the different stakeholders. The integrated analysis will analyze how the EU can mitigate the current shortcomings and optimize the balance between data protection and competitiveness.
