The object of this thesis is copyright infringements using illegal streaming on the Internet. Streaming technology is used extensively around the world for distribution of digital works online, using computers, tablets etc. Works can be viewed or listened to by using AVOD and VOD services, and Live-streams allows viewing real time programmes, which are often used in connection with football matches. The traditional way of copying or downloading is replaced, with this new technology. Unfortunately, streaming is also used illegally. Intermediaries on the Internet use streaming as a way of showing works illegally and gaining profit, even though it is an infringement to the copyright holders rights to the work. The treatment of this thesis is divided into a legal and an economic part, and in the end an interdisciplinary part, to understand the complexity between law and economy on the current issue. The first part of the thesis is the legal part; it deals with the legal understanding of the current law and the issues concerning copyright infringements using illegal streaming. By understanding what is considered illegal streaming and analysing current case law, in Denmark and the EU, the law enforcement and the effectiveness will then be considered. The second part of the thesis is the economic part. Copyrights can have a negative and a positive economic effect on the creation of a work. That is why; companies must pay particular attention to their choice of strategy in relation to their products on the Internet and how they can be differentiated in a market with many alternatives. The quality of the individual works are getting better and better, and thus it also creates competition in the market. Stakeholders on the market, have to consider their choices under the current law. Using vertical product differentiation, hereunder a quality differentiation model, the competition between the author and the intermediary on the Internet offering an illegal product are considered, as well as a consumers choice. Finally the interdisciplinary objective of the thesis will be fulfilled, by considering how the Copyright law should be, while taking into account the current law, case law, as well as the economic understanding.
