Abstract

The working paper concerns the EU-China Comprehensive Agreement on Investment (CAI) and its climate provision. It addresses the “When”, “Where”, and “How”. The “When” concerns when the CAI may enter into force. The paper provides an overview of some of the current issues that may be an obstacle for the parties to ratify the CAI. The “Where” concerns the law of particular institutions where the CAI may have an impact concerning protection of the climate. The paper focuses on the Belt and Road Initiative, the World Trade Organization, and International Climate Change Law. The “How” concerns how the CAI may have an impact—and to what degree—on the BRI, the WTO, and international climate change law.
