Locus Standi Challenges in Climate Litigation in a European Rule of Law Context

Abstract

Climate change has a negative effect on the life and health of human beings, animals, and the environment. The anthropogenic character of climate change has led individuals, and NGOs to use the courts to get governments to improve their climate policies. This article addresses the rule of law with particular focus on access to justice and locus standi. The article discusses the locus standi challenges in climate litigation in a European context and highlights new locus standi issues due to the special nature of climate change.
