Abstract

Insight 1 by Marek Giebel looks at the welfare considerations behind the design of the patent system and enforcement of intellectual property rights. In his analysis, Giebel focusses not only on the impact on innovation incentives for first inventors and follow-on developers, but also on the generic market entry by competitors.

Insight 2 by Kalpana Tyagi looks at the patent law perspective, and how these proprietary rights lead to the development of a blockbuster drug. Tyagi develops the discussion with Copaxone as a case study, and delves into how the divisionals game helped Teva profit from Copaxone long after the original formulation should have been off-patent.

Insight 3 by Maria Jose Schmidt-Kessen looks at the competition (& unfair competition) law perspective and on possible approaches to analyze divisional games by dominant undertakings under Article 102 TFEU.
