Civil Cooperation in the EU From 1960 to 2024

Abstract

The author presents the origins of the institutional framework for EU Civil Cooperation (Private International Law) to the present-day framework, as well as the various legislative acts that have been adopted over the last 64 years. He also discusses the flexible system of cooperation with enhanced cooperation and the use of reservations for certain Member States and argues that EU Civil Cooperation, from a harmonisation perspective, is very successful both in terms of quality and quantity. He finds that the EU Court of Justice has ensured uniform application and coherence in the interpretation of the harmonised rules. The author concludes that planning and hard work lie behind the very impressive legislative results achieved during the last 25 years and points to a few areas that could be covered in the future.
